Criminal proceedings related to the AN-26 plane crash near Chuguyev will be considered by the Chuguyev City Court of the Kharkiv Region – Supreme Court

On January 31, 2022, the panel of judges of the Second Judicial Chamber of the Criminal Court of Cassation as part of the Supreme Court considered the petition of the defense attorney of one of the defendants in criminal proceedings regarding the crash of the AN-26 plane, as a result of which 26 people died.

The defense attorney requested that this criminal proceeding brought to the EDPR for violation of flight rules or preparation for them (Article 416 of the Criminal Code of Ukraine) and negligent attitude to military service (Part 3 of Article 425 of the Criminal Code of Ukraine) be transferred from the Chuguyiv City Court of the Kharkiv Region to Vinnytsia City Court of Vinnytsia Region. He motivated his request by the fact that the crime of which his client is accused (negligent attitude to military service) was committed in the headquarters of the Air Force of the Ukrainian Armed Forces in Vinnytsia.

The prosecutor and the victims in the criminal proceedings were against granting the request of the defender, believing that the criminal proceedings should be considered at the place where the plane crash occurred.

The panel of judges of the CCS of the Supreme Court rejected the defense attorney’s request. Therefore, the consideration of the criminal proceedings will continue in the Chuguyiv city court of the Kharkiv region.
