Dmytro Buryak: Zelensky signed the law on compensation for destroyed and damaged housing

On Friday, March 17, President of Ukraine Volodymyr Zelenskyi signed the law on compensation for damage and destruction of certain categories of real estate objects as a result of hostilities, terrorist acts, and sabotage caused by the military aggression of the Russian Federation.

According to the law, the sources of funding for compensation for damaged and destroyed property will be funds from state and local budgets, international financial organizations, reparations or other recoveries from the Russian Federation.

The main provisions of the law:

  • Compensation will be provided exclusively for property (damaged/destroyed) from February 24, 2022;
  • The law will not apply to objects that were in the temporarily occupied territory on the date of the introduction of martial law;
  • Individuals – citizens of Ukraine who are owners will be entitled to compensation;
  • It will be impossible to receive monetary compensation for damaged property – for such cases, only restoration through construction works and/or provision of construction materials for them is offered;
  • There is no limit on the amount of compensation – both monetary and in the form of a housing certificate – as well as restrictions on the location, type and area of ​​new housing, the construction of which will be financed through the certificate;
  • If the housing price is lower than the amount specified in the certificate, the unreceived part of the compensation will be paid to the recipient only at the expense of funds received from the Russian Federation for compensation of losses;
  • The Commission for consideration of issues regarding the provision of compensation will consider applications and make decisions on granting or refusing to grant compensation for destroyed property. Such commissions will be created by executive bodies of local councils, military or military-civilian administrations of settlements.

We will remind you that back in February, the Verkhovna Rada of Ukraine adopted a law on the creation of a state register of property damaged and destroyed by the war and the procedure for compensation from the state.

In Ukraine, since the beginning of the full-scale war, more than 325,000 citizens have reported damaged or destroyed property through Diya.
