An investigation has been launched into the fact of the tragedy at the attraction, the work of which the prosecutor’s office demanded in court to stop

Under the procedural leadership of the Pechersk District Prosecutor’s Office of Kyiv, criminal proceedings have been initiated for the fact that the attraction “Rope crossing across the Dnipro River from the Arch of Friendship of Nations to Trukhanovo Island” broke off while a man was on it.

The investigation is conducted on the fact of violation of safety rules during the performance of work with increased danger and official negligence that caused the death of a person (Part 2 of Article 272, Part 3 of Article 367 of the Criminal Code of Ukraine).

The pre-trial investigation is being conducted by investigators of the Pechersk Police Department of Kyiv.

Please note that the Kyiv City Prosecutor’s Office tried to stop the operation of the specified attraction back in 2021. Prosecutors appealed to the Commercial Court of Kyiv with a lawsuit, in which they asked to declare illegal and annul the order of the Executive Body of the Kyiv City Council (KMDA) dated January 11, 2021, which recognized the winner of the investment competition as a company without experience in the implementation of similar projects and experience in the operation of attractions of a similar type. considering their potential danger to life and health.

The defendants in the case were the Executive Body of the Kyiv City Council (Kyiv City State Administration), CP “PLESO” and the Society-winner of the competition.

However, by the decision of the Commercial Court of Kyiv dated 02.12.2021, upheld by the decision of the Northern Commercial Court of Appeal dated 16.06.2022 and the Supreme Court dated 14.09.2022, the claim was refused.

The courts and the defendants represented by the capital’s officials did not agree with the position of the prosecutor’s office that the cable car across the Dnipro belongs to the attractions of increased danger.

Moreover, during the trial, it will be established that at the time of the investment competition and the trial, the design and technical documentation for the attraction had not been developed.

However, until today’s tragic incident, none of the officials of the KMDA, who held the contest to determine the winner, were bothered by this.
