The Cabinet of Ministers of Ukraine adopted a resolution on Tuesday, January 14, which grants the right to defer mobilization to the relatives of missing persons under special circumstances.
As it is explained, previously, in order to obtain a postponement, it was necessary to obtain a court decision to recognize a person as missing. However, the current legislation did not provide for a legal procedure for making such a decision by the court. The government’s ruling removes this legal conflict, it said in the Telegram channel of the CMU on Wednesday
As informs the Cabinet of Ministers, from now on, relatives will only need to obtain an extract from the Unified Register of Missing Persons in order to receive a postponement of mobilization.
It is noted that the category of persons who have the right to postpone conscription for military service during mobilization include, in particular: women and men whose close relatives (husband, wife, son, daughter, father, mother or relative (consanguineous, non-consanguineous) ) brother or sister) went missing during the defense of Ukraine and martial law; women and men (or guardians) raising a child (children) under the age of 18, if the second parent of such child (children) is recognized as missing or unaccountably absent.
It was previously reported that the Cabinet of Ministers allowed family members of captured or missing war veterans to use their benefits until they were released or declared missing or dead.
