The NBU applied measures of influence to the insurance company for concluding insurance contracts not in written form

The National Bank of Ukraine, based on the results of an unscheduled inspection, discovered the facts of violations of the requirements of the legislation on the protection of the rights of consumers of financial services in the activities of JSC “SC “OPIKA” (EDRPOU 32670627).

This is about non-compliance with the requirements of the Laws of Ukraine “On Insurance”, “On Financial Services and State Regulation of Financial Services Markets” (hereinafter – the Law), “On Electronic Commerce” and the requirements of the Civil Code of Ukraine regarding the written form of the insurance contract.

For concluding an agreement on the provision of financial services that is not in written form, the National Bank applies a fine in the amount of 300 to 600 non-taxable minimum income of citizens for each such case in accordance with clause 5 of the second part of Article 411 of the law

Therefore, in connection with the discovered facts of violation of the legislation on the protection of the rights of consumers of financial services under insurance contracts concluded with consumers in a non-written form, the National Bank applied measures of influence to JSC “SC “OPIKA” in the form of imposing fines in the maximum amount of 10 UAH 200 for each such case for a total of UAH 2,254,200.00. The use of such influence measures is justified by the nature and systematic nature of violations of the legislation on the protection of the rights of consumers of financial services by this company.

The Committee on Supervision and Regulation of Nonbank Financial Services Markets adopted such a decision on February 13, 2023.
