Electronic declaration of officials can be canceled in Ukraine. Decision by KSU

The Constitutional Court will consider a complaint regarding the unconstitutionality of the obligation of officials to submit electronic declarations and may cancel such a provision.

This is stated in the statement of the NAKC, Ukrainian News Agency reports.

The Constitutional Court of Ukraine (CSU) will consider the case regarding the constitutionality of certain provisions of the law “On Prevention of Corruption”, which oblige officials to submit e-declarations and empower the National Agency to verify them.

On this occasion, the head of the NAKC Oleksandr Novikov wrote a letter to President Volodymyr Zelenskyi and described the risks of a possible decision of the KSU in this case.

On June 15, the Supreme Court opened proceedings in the case.

The complaint was filed by lawyer Oksana Bukhtoyarova regarding the conformity of certain provisions of the Law “On Prevention of Corruption” with the Constitution.

In particular, the lawyer contests the provisions that define the circle of persons who are equal to the subjects of the declaration, oblige officials to submit electronic declarations every year and establish types of control over them.

“Recognizing the provisions of the Law related to financial control as unconstitutional can completely nullify the process of e-declaration in Ukraine and make the effective work of anti-corruption bodies impossible. This will significantly undermine achievements in the field of anti-corruption and, as a result, will negatively affect both the financial support of Ukraine’s international partners and its European integration prospects. The decision of the KSU adopted within the specified case, which is binding and not subject to appeal, may lead to a crisis at an extremely difficult time for the country,” Novikov’s letter to the president states.
